The EU AI Act has generated a lot of coverage. Most of it has focused on high-risk AI systems, prohibited applications, and enterprise compliance obligations that read like they apply to technology companies, not ordinary businesses.
That framing has led many U.S. SMB owners to conclude this is someone else's problem.
It isn't.
Article 4 of the EU AI Act β which went into force in February 2025 β applies to any organization whose employees use AI tools in their work and who are subject to EU jurisdiction. The requirement is specific, practical, and already active. Enforcement begins August 2, 2026.
This post cuts through the legal noise. Here's what Article 4 actually says, what "AI literacy" means in practice, whether your business is in scope, and what you need to have in place before the enforcement clock runs out.
What Article 4 Actually Says
The official text of Article 4 β the "AI literacy" provision β requires that:
"Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, having regard to their technical knowledge, experience, education and training and the context the AI systems are to be used in."
Let's translate that into plain English:
If your employees use AI systems as part of their work, you are legally required to ensure they have sufficient AI literacy for how they're using those systems. That means documented training appropriate to their roles and the AI tools they're using. Not an internal memo. Not a policy that sits in a folder. Documented evidence that your people have been educated on AI risks, appropriate use, and your organization's requirements.
The standard is not "awareness." It's demonstrated, documented competency appropriate to the context of use.
Who Is In Scope
Here's where U.S. businesses often stop reading, assuming EU law doesn't apply to them. That assumption is increasingly wrong.
The EU AI Act applies based on where AI systems are deployed and used, not just where the organization is headquartered. Specifically:
You are likely in scope if:
- You have EU-based employees or contractors who use AI tools as part of their work
- You provide services to EU customers using AI systems that they interact with
- You use AI systems that process data about EU residents in any meaningful way
- Your AI-using employees work with EU business partners in contexts where the Act's deployer obligations attach
For U.S.-headquartered companies with any EU footprint β a remote employee in Europe, a client base that includes EU companies, a vendor relationship with an EU organization that involves AI-mediated workflows β the reach of Article 4 is real and should be evaluated with counsel.
Even if your EU exposure is limited or unclear today, Article 4 compliance is worth pursuing for a separate reason: the insurance market is treating it as a governance standard regardless of jurisdiction. U.S. carriers are beginning to use EU AI Act compliance as a proxy for organizational AI governance maturity. Whether or not you're legally required to comply, demonstrating compliance signals that your AI use is managed and documented.
What "AI Literacy" Means in Practice
The Act doesn't prescribe a specific training curriculum or duration. What it requires is that training be appropriate to the role and the context of AI use. That standard has a few practical implications:
Training must be tailored to use. A developer using AI coding assistants needs different training than a customer service representative using an AI chatbot. The standard is not a one-size-fits-all annual course β it's training that prepares people for how AI actually shows up in their work.
Documentation is mandatory. Informal awareness isn't enough. The Act's evidentiary standard requires that you can demonstrate employees received training and that the training was adequate. This means completion records, certificates, or other verifiable documentation.
Updates are expected. The AI landscape is moving fast. An organization that trained employees in 2024 and hasn't revisited since may find its documentation stale relative to the tools its employees are now using. Regulators are expected to look at whether training kept pace with the organization's actual AI deployment.
The policy and the training work together. AI literacy training is most defensible when it's paired with a documented AI use policy β so employees can point to specific organizational rules they were trained on, not just general AI risk awareness.
What Enforcement Looks Like
The EU AI Act's enforcement structure varies by jurisdiction β each EU member state is responsible for establishing a national supervisory authority. Penalties for non-compliance can reach 3% of global annual turnover, with higher caps for more serious violations.
For Article 4 specifically, the practical enforcement question is: can you demonstrate, if asked, that your organization has taken reasonable measures to ensure AI literacy for employees working with AI systems?
That demonstration has two components:
- A documented AI use policy that establishes what your organization's requirements are
- Training records showing that employees were educated on those requirements
Regulators conducting audits or investigating complaints will ask for exactly these things. Organizations that have them are in a defensible position. Organizations that don't are not.
August 2, 2026 is the date by which the full enforcement framework is expected to be operational across EU member states. That's not a distant deadline. If your organization is in scope and starting from zero today, you have roughly three months before enforcement is operational β which is tight regardless of workforce size.
Why the August 2026 Date Matters Even If You're Not in the EU
U.S. cyber insurance carriers are watching the EU AI Act closely, and several have already begun incorporating AI governance questions into renewal applications that reference EU compliance standards as benchmarks.
The logic: a company that can demonstrate Article 4 compliance β documented policy, documented training, verifiable records β is a company that has managed its AI risk. That's a better-risk profile than a company that can't demonstrate those controls, regardless of whether the EU Act technically applies.
Beyond insurance, U.S. regulatory momentum is moving in the same direction. Federal AI policy is evolving. State-level AI legislation is active in multiple jurisdictions. The EU AI Act won't remain an outlier β it's the leading edge of a broader governance wave. Building compliance infrastructure now positions your organization ahead of what's coming.
The Practical Checklist
If you're trying to assess where your organization stands on Article 4 readiness, here are the questions to answer:
Policy:
- Does your organization have a documented AI use policy?
- Does it address which tools employees can use, what data is permitted, and what their responsibilities are?
- Is it current β reflecting the AI tools your employees actually use today?
Training:
- Have your employees completed AI literacy training appropriate to their roles?
- Is that training documented with individual completion records?
- When was it last updated?
Records:
- Do you have a completion certificate or equivalent documentation for each employee?
- Is that documentation organized in a way that you could provide to a regulator, insurer, or client if asked?
Maintenance:
- Do you have a process for updating your policy and training when your AI tool stack changes or when regulations evolve?
- Do new employees receive AI literacy training as part of onboarding?
If the answer to most of these is no or "we're working on it," the gap is significant but closeable.
